105 Expanded Maternity Law IRR and Other Cases



Female employees who gave birth on March 11, 2019, and onwards shall be entitled to 105 days of maternity leave with full pay.

EXPANDED MATERNITY
Implementation of R.A. No. 11210

Effectivity: MARCH 11, 2019

105 DAYS - Maternity with full pay.

60 DAYS - For those who suffered miscarriage or emergency termination of pregnancy.

30 DAYS - Option to extend leave with or without pay.

15 DAYS - Additional maternity leave, for qualified solo parents pursuant to R.A. No. 8972

7 DAYS - Out of 105 DAYS maternity leave may be allocated to the following:
> child's father
> to an alternate caregiver who may be a relative
> the current partner sharing the same household

Female workers who have given live childbirth on March 11, 2019, but were only granted sixty days maternity leave their agencies prior to the issuance of the IRR shall automatically be granted 105 days maternity leave with full pay. No additional notice to the agency shall be necessary for the completion of the 105 days maternity leave.
